Abstract

The author proposes in this study to harmonize the different European payment order proceedings, rather than to create an uniform procedure, in order to obtain the creation of an executive title without exequatur, which produces a res judicata effect (named « Titre executoire europeen » that is « European Executive Title ») for civil and commercial debts with an apparently indisputable nature.
