Funciones y tutela de la representación legal de las personas trabajadoras en la Ley 2/2023, de protección de las personas informantes de infracciones

In Law 2/2023, of February 20, regulating the protection of whistleblowers and combating corruption, our legislator, following the Directive it transposes, has been very brief regarding the functions of workers' legal representatives (WLR), with only two explicit references to such representation in its provisions. However, in addition to analyzing these explicit references, this study examines other regulations from which it is possible to deduce a greater role for such representation in very important aspects of Law 2/2023, especially when its members may be whistleblowers or persons concerned. In any case, these functions of legal representation directly or indirectly related to that law must be contrasted with the markedly more important functions that other alternative complaint channels reserve for said representation, as is the case in the procedures provided for in equality plans,in the protocols for the prevention of harassment and even in complaints before the Labor and Social Security Inspectorate.
