Abstract

Labor relations nowadays are substantially atomized and productive outsourcing is a common practice in many economic sectors, creating at times situations of obvious social inequality among workers employed by the parent company and workers hired by the contractor. In this context, the objective of this paper is to analyze the outsourcing regulation and determine whether EU and Spanish regulation offer an adequate response to guarantee adequate social protection standards. Furthermore, the paper analyzes the legal feasibility of introducing at EU level a principle of equal treatment in the context of outsourcing.
