Abstract
Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December on the promotion of the use of energy from renewable sources (DRES) and Directive (EU) 2019/944 of the European Parliament and of the Council of 5 June on common rules for the internal market in electricity (EMR) contain similar definitions of energy community; but not identical.
The text carries out a thorough examination of the provisions in the directives and their justification in the considerations thereof to identify the characteristics of their legal nature, potential participants, primary objectives, and activities to be carried out. Elements, all of them, that the transposition in Spain must contemplate. The text makes comments and proposals to articulate a framework that facilitates its development.
