Resum

This entry examines Tribal Constitutions as foundational instruments of Indigenous self-government and situates them within the broader framework of Tribal Constitutionalism. It argues that Indigenous peoples developed sophisticated constitutional orders long before colonial contact, often based on oral traditions, customary law, and collective governance. The study traces the emergence of written Tribal Constitutions, particularly in the United States, where they evolved from defensive responses to colonial expansion into tools of self-determination and political organization. It compares developments in the United States, Canada, and New Zealand, highlighting how constitutional recognition of Indigenous rights has shaped different forms of Indigenous governance. The entry also explores tensions between externally imposed constitutional models and Indigenous legal traditions, especially under assimilationist policies. While many Tribal Constitutions reflect Western constitutional forms, Indigenous communities have increasingly adapted them to express their own political aspirations and cultural values. The analysis emphasizes that written constitutions represent only one dimension of a much broader Indigenous constitutional tradition. Ultimately, the article demonstrates that Tribal Constitutions provide valuable insight into both Indigenous governance and the limits of state-centered constitutionalism
