Regulation of the Economy in the pursuit of public interest and effects and side effects on individual happiness

Resum

In the XVIII century, the Declaration of Rights of Virginia linked the enjoyment of liberty as a mean of acquiring and possessing property and pursuing and obtaining happiness and safety. In the XX century, the Universal Declaration of Human Rights added equality with references to social security and the standard of living adequate for the health and well-being of himself and of his family. So, the right to pursuing happiness was, in part, transformed into a right to well-being, publicly provided, that makes easier for individuals to act pursuing their individual happiness. Public interest does not mean public happiness, just public well-being. Regulation of the Economy has the goal to achieve public well-being and, in this sense, it empowers individuals to drive their lives pursuing their personal happiness. To get that public goal (public well-being) regulation limits individual property and also individual freedom of choice. On the other hand, there is not a universal concept of happiness for everyone, everywhere, every time. This is a quite particular matter of self-awareness. In this paper I will consider, focusing on some examples related to energy law, how legislation and regulation of the Economy pretend to assure a level playing field of public and individual well-being that sometimes matches with the individual idea of personal happiness, and sometimes no. Having arrived at this point we can ask ourselves if legislation and regulation decides not only public well-being, but also, directly or indirectly, what kind of happiness we have the right to pursue.
