Resum
The survey carried out on the method of legal comparison in a diachronic key in Amico di Meane’s book offers the cue to reflect on the need for today’s jurists to overcome the constraints of legalositivism and legalism through the study of other and different legal systems and systems, starting with the Anglo- Saxon ones and ending with those of the nations of the Far East. In this way, it is possible to break the cage in which European systems, by means of codes, have enclosed jurists, who are strictly subordinated to the law and deprived of the function of interpreting the law. Comparison in time (i.e. legal history) and space (comparative law) can be effective antidotes against the reductivism and legal absolutism that, in terms of sources, have characterised contemporary legal experience, reducing legal science to silence, to the benefit of the legislator (i.e. the holder of political power).
