Resum
The V AENC represents an important regulatory framework for the application of AI in labor relations, in which collective agreements can play a central role in regulating this disruptive technology. However, this study shows that this role is still very limited, especially considering that the new digital rights and duties related to AI and algorithmic management, such as those of supervision, explanation, review, and rectification, mainly with respect to automated decisions, are still and to a large extent unpublished in our collective agreements. In addition, one of the premises contained in that V AENC regarding the development of a necessary «human control» of AI has evident technical difficulties, especially with respect to the most advanced systems of this technology, difficulties that will have to be addressed more specifically by future collective bargaining.
