Compensación económica por razón de trabajo y pensión compensatoria: pluralidad de leyes aplicables y necesidad del mecanismo de la adaptación. Comentario a la STSJC, Sala Civil y Penal, 22.9.2008 (MP: Ma. Eugènia Alegret Burgués)

The Catalan Supreme Court has ruled again on the economic compensation between spouses for working reasons, regulated in section 41 of the Catalan Family Code. This time the Court has decided on two very important issues for international marriage crisis. On the one hand, the legal nature of the mentioned compensation and its characterisation in order to determine the proper conflict of laws rule. On the other hand, the scope of the law applicable to the marriage crisis regarding the effects of nullity, separation and divorce. This paper explores both questions to conclude that the possibility to submit to different national laws the several effects of an international marriage crisis requires the introduction of a mechanism aiming to adjust those laws (¿adaptation¿) in order to avoid unfair results.
