Resum
This study anlyzes the legal regulation of the procedural exceptions in the Law 1/2000, of 7th January, of Civil Procedural (LEC), because one of the functions of the preliminary hearing is to resolve any procedural exception.
The study begins fixing the concept of procedural exception, the order of resolution of the procedural exceptions and the possibility of a difered resolution, that means after ending the preliminary hearing. Next we analyze each one of the procedural exceptions, its legal and case-law interpretation, and the advantatges that can be introduced in the legal regulation.
The study ends analyzing how procedural exceptions must be apellated in the preliminary hearing and offering, in a way of lege ferenda proposal, the legal setting of articles 416 to 425 of the Civil Procedural Law, with all advantatges reasoned along the study.
